The following is the description of allowed materials and the required maintenance on the fences, walls and retaining wall constructions:

(1) Allowed Materials for Permanent Fence.

(a) Materials with texture and other features that produce a stable and desirable character complementing the design and values of the surrounding district. Any fence considered by the zoning administrator to not be a standard or customarily styled or constructed fence is prohibited.

(b) Partition walls are to be constructed of brick, stone, textured concrete, precast concrete. Brick or stone columns may be incorporated into fencing but no spacing more than 20 feet on center. Pictures, images, lettering, logos, graphics, or artwork are not permitted on walls unless permitted in accordance with the city’s sign regulations.

(2) Prohibited Materials for Permanent Fence.

(a) A fence or wall may not be designed to cause pain or injury to humans or animals. Therefore, the use of spikes, broken glass, barbed wire, razor wire, nails, electrical charge or other similar materials shall be prohibited, unless specified otherwise herein. Fences constructed with barbed wire are specifically prohibited in IGCC 9.25.140.

(b) It is prohibited to use materials such as sheet metal panels, wood panels used in building sheathing, chicken wire, temporary construction fencing, snow fencing, or woven wire commonly used for the penning of livestock or other animals.

(c) Because of public safety concerns all fences must be of a color or nonreflective surface that does not distract a motorist’s attention traveling on abutting streets or alleys. Pictures, images, lettering, logos, graphics, or artwork are considered to distract motorists and as so are not permitted on fences.

(3) To prevent a nuisance described in IGCC 15.10.020, all fences and walls shall be constructed in a sound and sturdy manner and shall be maintained in a good state of repair, including the replacement of defective parts, painting, and other acts required for maintenance. Wooded fences shall be constructed of a wood that is resistant to decay.

(4) The city shall follow the nuisance abatement detailed within IGCC 15.10.020 if there is lack of maintenance or repair to the extent it presents a safety concern. An extension of time to repair may be granted, upon filing a statement with the city clerk of verifiable facts that the delay is not a result of any act of the owner. [Ord. 599, 2021.]
