As used in this chapter, the following words have the following meaning:

“One-course construction” means that the full thickness of the concrete is placed at one time, using the same mixture throughout.

“Portland cement” means any type of cement except bituminous cement.

“Property owner” means the contract purchaser, if the contract is filed for record, otherwise the record holder of legal title.

“Sidewalk defect” means any public sidewalk exhibiting one or more of the following characteristics:

(a) Repair Code A. The sidewalk is cracked with a vertical edge existing of more than three-quarters-inch-high or a horizontal opening of one inch or more.

(b) Repair Code B. The sidewalk has raised more than two inches in an eight-to-10-foot area from the normal line of grade of the sidewalk.

(c) Repair Code C. The sidewalk is depressed more than two inches in an eight-to-10-foot area from the normal line of grade of the sidewalk.

(d) Repair Code D. The sidewalk has cracked into more than three pieces per four-foot by four-foot square and sections are distorted or distressed with a vertical height difference of three-quarters of an inch or more or a horizontal separation of one inch or more.

(e) Repair Code E. The sidewalk has cracked and part of the sidewalk is missing, forming holes.

(f) Repair Code F. The sidewalk has settled or for some other reason is sloped and tilted more than one inch per foot toward either side.

(g) Repair Code G. The sidewalk has spalled and the surface is gone.

“Sidewalk reconstruction” means the removal and rebuilding of a public sidewalk, including the excavation, filling and depositing of material in the public right-of-way in connection therewith. The reconstruction work to be performed in accordance with established city specifications in effect at the time the work is commenced. [Ord. 409 § 1, 1989; Code 1975 § 8-2.02.]
