Any person entitled to file a complaint with the council pursuant to this chapter may file, on his own behalf, a civil action in the district court of Ida County in which discriminatory housing is alleged to have occurred. Such action shall be commenced within 108 days after the complaint arose, or it shall be waived. The action authorized by this section shall be considered an alternative to the other procedures provided by this chapter, and shall be prohibited while the complainant has a complaint under consideration by the council until such complaint is withdrawn, and no action pursuant to this section shall be permitted if an action on behalf of the complainant has been initiated pursuant to IGCC 8.25.120.
