The following words and phrases when used in this chapter shall have, unless the context clearly indicates otherwise, the meanings given to them in this section.

“Aluminum cans” means empty all-aluminum beverage and food containers; except those aluminum beverage cans returned by the resident for redemption at a can and bottle redemption center.

“Bimetal containers” means empty beverage or food containers consisting of sides and bottom and an aluminum top.

“Collector” for purposes of collecting and transporting solid waste and/or recyclables means the city of Ida Grove, Iowa, or its duly authorized contractors.

“Commercial establishment” means any premises engaged in retail trade or sale of goods. Expressly included are all restaurants and taverns, all industrial or manufacturing businesses, and all types of offices including governmental agencies.

“Corrugated paper” means paperboard or cardboard boxes constructed in a fluted manner.

“Curbside recycling collection” means the scheduled collection and transportation of recyclable materials placed at the curbline or other area designated by the collector.

“Dwelling unit” means a single unit providing complete independent living facilities for one or more persons including permanent provisions for living, sleeping, eating, cooking and sanitation.

“Dwellings”:

(a) “Multifamily housing facility” means a building or portion thereof containing more than two dwelling units and not classified as a one- or two-family dwelling.

(b) “One-family dwelling” means a building containing one dwelling unit only.

(c) “Two-family dwelling” means a building containing two dwelling units only.

“Enforcement officer” means the official designated herein or otherwise charged with the responsibilities of administering this chapter, or the official’s authorized representative.

“Executive director” means the executive director of the State Department of Environmental Quality or his designee.

“Glass containers” means bottles and jars made of flint, green or amber glass; except those glass jars returned by the resident for redemption at a can and bottle redemption center. Expressly excluded are noncontainer glass, plate glass, blue glass, lead crystal, and porcelain and ceramic products.

“High density polyethylene (HDPE) containers” means plastic bottles and jars made exclusively from high density polyethylene.

“Litter” means either municipal waste or recyclable materials.

“Magazines” means printed matter printed on slick or glossy paper containing contaminants not found in newsprint.

“Medical waste” refers to all solid waste generated in healthcare settings. Infectious waste is a subset of medical waste, including, but not limited to, contaminated sharps, cultures, and stocks of infectious agents, blood and blood products.

“Municipal waste” means any garbage, refuse, industrial, lunchroom or office waste or other material, including solid, semisolid or contained gaseous material, resulting from operation of residential, municipal, commercial or institutional establishments and from community activities. Also included in any sludge not meeting the definition of residual or hazardous waste in Iowa Code, Section 455B.411, from a municipal, commercial or institutional water-supply treatment plant, wastewater treatment plant or air pollution control facility. This term does not include source-separated recyclable materials.

“Newspaper” means paper of the type commonly referred to as newsprint and distributed at fixed intervals. Expressly excluded are newspapers which have been soiled.

“Occupant” means any person living and/or sleeping in a dwelling unit.

“Open burning” means any burning of combustible materials where the products of combustion are admitted into the open air without passing through a chimney or stack.

“Person” means any individual, partnership, municipal waste hauler, scrap dealer, corporation, association, institution, cooperative enterprise, municipality, municipal authority, federal government or agency, state institution or agency, or any other legal entity whatsoever which is recognized by law as the subject of rights and duties. In any provisions of this chapter prescribing a fine, imprisonment or penalty, or any combination of the foregoing, the term “person” shall include the officers and directors of any corporation or other legal entity having officers and directors.

“Polyethylene terephthalate (PET) containers” means plastic soda bottles or other containers composed of the polymer PET.

“Recyclable materials” means any used material having an economic value in the secondary materials market and includes aluminum cans and articles, bimetal cans, glass containers, corrugated paper, steel cans, newspaper, paper products not chemically coated, plastic polyethylene terephthalate (PET) bottles, plastic high density polyethylene (HDPE) containers and other materials designated by ordinance by the municipality as having value.

“Sanitary disposal project” means all facilities and appurtenances including all real and personal property connected with such facilities, which are acquired, purchased, constructed, reconstructed, equipped, improved, extended, maintained or operated to facilitate the final disposition of municipal waste without creating a significant hazard to the public health or safety, and which are approved by the executive director.

“Steel cans” means all empty steel food and beverage containers.

“Toxic and hazardous waste” means waste materials including, but not limited to, poisons, pesticides, herbicides, acids, caustics, pathological waste, flammable or explosive materials and similar harmful waste which requires special handling and which must be disposed of in such a manner as to conserve the environment and protect the public health and safety.

“Yard waste” means organic debris (e.g., grass clippings, leaves, tree limbs, bark, branches, flowers, etc.) which is produced as part of yard and garden development and maintenance. [Ord. 424-A § 1, 1992; Code 1975 § 3-4.0103.]
