(1) All residences and business establishments within the city limits intended or used for human habitation, occupancy or use shall be connected to the public water system.

(2) No persons or businesses may use or dig private water wells within the city limits. Private water wells existing on the date of the ordinance codified in this section may continue to be used. The water taken from any such pre-existing private well in any calendar year may not exceed the amount of water taken from that well in the previous calendar year. Closed loop ground source heat pumps (defined as heat pumps that do not draw water from below the ground or inject water into the environment) and open loop ground source heat pumps (defined as heat pumps that inject the water back into the same aquifer from which it was taken and no more than 75 feet laterally or 10 feet horizontally from where it was taken) are not prohibited by this section.
