(1) Permit. No person shall dig, excavate or in any manner disturb any street or alley or adjoining road right-of-way in the city, unless such person shall first obtain a permit therefor from the city clerk after filing a proper application giving a description of the location of the excavation, the purpose of the excavation and who will be responsible to refill the excavation and return it to its original condition. The excavation provisions of IGCC 13.15.140 shall apply where consistent with this section. A permit will not be issued until the applicant furnishes proof to the city clerk that the excavation will not damage existing utilities.
