The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this chapter, except where the context clearly indicates a different meaning:

“Commercial driveway approach” means a driveway approach providing access to an office, retail or institutional building; to an industrial or commercial development; or to an apartment building having five or more dwelling units.

“Curb cut,” “curb drop” or “curb opening” means any depression in the curbing along the traveled portion of a street right-of-way originally designed or later created to facilitate passage of motor vehicles between that street and any private property adjacent to it.

“Driveway approach” means any area between the right-of-way line of any public street and the traveled portion of that street used for the purpose of providing access for motor vehicles from the traveled way of the public street to any private property adjacent to the street.

“Driveway approach width” means the width of the driveway approach measured both at 10 feet from the curb line of any public street and the boundary line of the right-of-way property line except where the driveway radii are greater than the distance between the right-of-way line and traveled portion of that street, in which case the width of the driveway approach shall be measured at the end of the driveway radii on private property.

“Driveway curb interface” means the type of curb cut, drop or opening.

“On-street parking” is a portion of a roadway that is used for parking cars and other vehicles within the street right-of-way.

“Parcel of land” means any portion or number of lots with the same owner and with the same use.

“Paving” means a hard surfacing material including, but not limited to, Portland cement, concrete, bituminous concrete, brick, or combinations of such materials, with their necessary base. “Paving” shall not include surfacing with oil, gravel, or chloride.

“Public property,” in addition to its usual meaning, means any street, highway, avenue, alley, sidewalk, right-of-way, public place or other real property owned or controlled by the city.

“Permanent driveway approach” means a driveway approach constructed on a street which is improved with permanent street surfacing. Such permanent driveway approaches can only be surfaced with paving in conformance with SUDAS specifications.

“Residential driveway approach” means a driveway approach providing access to a single-family residence, to a duplex, or to an apartment building containing four or less dwelling units.

“Temporary driveway approach” means a driveway approach surfaced with a material other than Portland cement or asphaltic concrete not in conformance with SUDAS specifications. [Ord. 598, 2021; Ord. 567 § 1, 2019; Code 1975 § 8-4.01.]
