(1) A driver of a vehicle which persists in a congesting condition or permits another driver to persist in a congesting condition after being warned by law enforcement personnel to desist from participating in the congesting condition shall be guilty of a simple misdemeanor.

(2) A congesting condition shall exist if vehicle traffic flow cannot proceed on the public streets at a sustained rate of one block (400 feet) per minute for a period of 10 minutes.

(3) If law enforcement personnel determine that a congesting condition exists, they shall warn the drivers of vehicles participating in the traffic flow that they must cease and desist from participating in the congested traffic flow for a period of 30 minutes after the warning and if the vehicle returns to the traffic flow during the 30-minute period of time, the warned driver shall be in violation of this section.
