(1) Recreational Purposes.

(a) Fences associated with the uses of a sports or recreational facility, or other similar area, shall not be subject to the height restrictions specified elsewhere in this section. Any such fence is subject to design review and approval of the zoning administrator.

(b) Fences associated with an accessory use tennis, basketball, or similar ball courts located on a single-family residential lot (R-1 or R-2 zoning district) may be over six feet but not more than 12 feet in height provided the fence is located in the rear yard and meets the setback requirements of the principal structure. Any such fence is subject to design review and approval of the zoning administrator.

(c) Swimming pool enclosures are subject to the requirements of the municipal building code, Chapter 15.20 IGCC.

(2) Temporary Fences.

(a) Temporary construction fences, barricades, railings, or other similar fences installed to provide temporary site security and/or safety in conjunction with construction work may be allowed in any district and within rights-of-way during periods of construction. Any such temporary fences shall be removed upon completion of the construction work.

(3) Gardening.

(a) A gardening fence used in vegetable or other gardening that is contained completely within the owner’s lot or parcel, of a height of 36 inches or less, is exempt from permit requirement.

(4) Public and State Entities.

(a) Public entities are exempt from the requirements within this chapter only if they are following mandated state requirements.

(b) State road and highway projects are exempt from the requirements within this chapter if they are following state requirements. [Ord. 599, 2021.]
